NOW New York State, Inc. strongly supports this legislation that provides courts more leverage to bar alleged batterers from the home of the victims, preventing further physical, emotional or sexual abuse.
Orders of protection are often issued that only restrain the battered from certain inappropriate behavior in the presence of the victim; yet still allow them to reside in the same home. Former victims have repeatedly testified that current orders of protection are ineffective in preventing the batterer from having contact with the victim. In many cases, victims of domestic violence have real concerns of continued and more severe abuse once the violence has been reported and an ineffective order is used. By barring the batterer from the home, this legislation would provide additional security to abuse victims from their attackers.
This legislation makes it clear that, under certain circumstances the court should consider removing the batterer from the home in order to protect the victim from further abuse.
The National Organization for Women - New York State, Inc. strongly urges the New York State Legislature to support A-00287 to protect victims of domestic violence from further abuse and attacks.
